Supreme Court

Our Supreme Court Is Unique

After watching the video in class today, I realized that our supreme court is one of a kind. The lowest court system is the district court and they weigh facts. After they weigh facts, the appeal is mandatory and it moves up to the appellate court. The appellate courts follow the due process law which follows the 5th and 6th amendments. Then, it moves up to the supreme court and they have an optional (certiorari) appeal.

The video also showed me how beautiful it is inside the supreme court building. It is a very elegant and sophisticated place.

There are two modes of constitutional interpretation which are judicial restraint and judicial activism. Judicial restraint is conservative which equals slow or no change which equals "starè decisis" and upholds precedent. Judicial activism is liberal which equals rapid or sweeping change which equals "strike down" and overturns precedent.

Common and Constitutional law is judiciary, Statutory law is legislative, and Administrative law is executive.  The definition of common law is a law that builds up over time through court cases.
